THE PREVIOUS BATTLES FOR THE LOWER & UPPER ROUGH Back in 2016, Inspector Mike Robins ruled in favour of allowing development on the Lower Rough, but dismissed the larger development covering the Upper Rough. The permission was ONLY granted because Pendle did not have a five year housing land supply as required by the NPPF. Hence, his hands were tied in overturning the councillors' decision to reject the development. After the decision, L&B continued working on the Reserved Matters and the Conditions to ensure the development was as good as it could be and made the developers, McDermott, work hard and sweat over every single point. Now, as expected, a new planning application for the Upper Rough has been submitted by Accrue Capital for the development of a 150 house estate - wholly unsustainable and unsuitable, and simply not addressing the matters raised in the Inspector's judgement of 2016.
